These Website Terms of Use ("Terms") are between you and DuraMax Building Products, a division of US Polymers, Inc. ("DuraMax," "we," "us," or "our"). By accessing or using DuramaxBP.com or another DuraMax website or digital service that links to these Terms (collectively, the "Site"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Purpose of the Site

The Site provides information about DuraMax products, product resources, dealer and retailer locations, support, warranty registration, project inquiries, professional programs and related services. Information on the Site is provided for general informational and commercial purposes and may be changed without notice.

2. Eligibility & Lawful Use

You may use the Site only for lawful purposes and in accordance with these Terms. If you submit information, request a quote, register a product, create an account or enter into a transaction through the Site, you represent that the information you provide is accurate and that you have authority to provide it.

3. Product Information, Specifications & Availability

We make reasonable efforts to present product information accurately. However, colors, dimensions, specifications, packaging, included components, features, availability, pricing and other product details may change and may vary by model, retailer, region or production run. Images may show optional accessories, landscaping, furnishings or installations not included with a product.

Before purchase, installation or specification, review the current product page, installation instructions, warranty and documentation for the exact model you are considering. Dealer or retailer inventory, pricing, delivery, installation and return terms are controlled by the applicable seller unless DuraMax expressly states otherwise.

4. Quotes, Leads & Dealer Information

A quote request, dealer search, project inquiry or form submission does not create a contract or guarantee product availability, pricing, territory, dealer appointment, project acceptance or delivery. We may refer inquiries to independent dealers, retailers, distributors, contractors or affiliated companies where appropriate. Those parties may have their own terms, privacy practices and contractual relationships with you.

5. Orders, Payments & Third-Party Transactions

If purchasing functionality is made available through the Site, additional checkout, payment, shipping, return or transaction terms may apply. Payment processing may be provided by third parties. Purchases made through independent retailers, marketplaces, dealers or other third parties are governed by the terms of the applicable seller.

6. Accounts & Security

If any portion of the Site requires an account or password, you are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account. Notify us promptly if you believe your credentials or account have been used without authorization.

You may view, download or print Site materials for personal, non-commercial use or legitimate evaluation, purchase, installation or support of DuraMax products, provided you do not remove proprietary notices. Any other reproduction, distribution, modification, republication or commercial use requires prior written permission unless otherwise permitted by law.

9. User Submissions

If you submit photographs, comments, reviews, project information, documents, ideas or other content to us, you represent that you have the right to provide that content and that it does not violate the rights of others. Unless a separate written agreement says otherwise, you grant DuraMax a non-exclusive, worldwide, royalty-free right to use submitted content as reasonably necessary to respond to your request, provide support, administer warranties, operate our business and, where you have authorized it, use the content for marketing or promotional purposes.

Do not submit confidential, proprietary or sensitive information unless it is reasonably necessary for the service you are requesting.

10. Third-Party Websites, Tools & Services

The Site may contain links to or integrations with third-party websites, dealer sites, retailers, maps, chat tools, payment services, social platforms or other services. We do not control third-party services and are not responsible for their content, availability, security, terms or privacy practices. A link does not necessarily mean that DuraMax endorses the third party.

11. Product Warranties

These Terms do not replace, expand or reduce any written product warranty. Product warranties vary by product line and model. The applicable written warranty controls warranty coverage, exclusions, remedies and claim procedures. Current warranty information is available on our Warranty page.

12. Website Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." DURAMAX DISCLAIMS WARRANTIES REGARDING THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT PERMITTED BY LAW.

We do not warrant that the Site will always be available, uninterrupted, secure or error-free, or that every item of website content will always be complete or current.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DURAMAX, US POLYMERS, INC., THEIR AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF, OR INABILITY TO USE, THE SITE.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. Product-related claims remain subject to applicable law and the written warranty or contract governing the applicable product or transaction.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DuraMax, US Polymers, Inc. and their affiliates from claims, losses, liabilities and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms or your infringement of another person's rights.

16. Changes to the Site or These Terms

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent another law must apply. Any dispute relating solely to use of this Site will be subject to the courts having jurisdiction over US Polymers, Inc., unless applicable law requires otherwise.

18. Severability & No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. A failure to enforce any provision is not a waiver of that provision.
